Michigan’s Earned Sick Time Act and its three-day rule

Michigan’s Earned Sick Time Act (ESTA) took effect on February 21, 2025, after a Michigan Supreme Court decision reinstated a 2018 voter-approved law and the legislature amended it. Most employees now accrue at least one hour of paid sick time for every 30 hours worked, which can be used for their own illness, preventive care, or to care for a family member.

The law is specific about documentation. An employer can require reasonable proof that earned sick time was used for a covered reason, but only once an absence runs more than three consecutive days. Even then, the employer cannot require an employee to disclose the nature of the illness or condition, only that the time was used appropriately. For a shorter absence, or for time off that isn’t ESTA sick time, whether you need a note comes down to your employer’s own attendance policy.

Verifying a physician’s Michigan license

Physicians and osteopathic physicians practicing in Michigan are licensed through the Department of Licensing and Regulatory Affairs (LARA). LARA’s “Find / Verify a Licensed Professional” tool lets anyone search the Medicine and Osteopathic Medicine & Surgery categories to confirm a specific physician’s license is active. That lookup checks the doctor’s credentials; it’s separate from your own note, which only you can choose to share with an employer or anyone else.

Before CuroNote launches in Michigan

CuroNote hasn’t launched in Michigan yet. The site is in a pre-launch reserve phase: no payment is collected, and no physician is currently reviewing requests. Once live, a physician licensed in Michigan will review each intake and, if appropriate, sign a note the same day.

Can my employer ask for a note for one or two sick days?

For paid earned sick time under Michigan's Earned Sick Time Act, an employer can require documentation only when the absence is more than three consecutive days, and cannot require you to disclose the nature of the illness. For shorter absences, or time off outside ESTA, it depends on your employer's own policy.

Can my employer ask what illness I have?

No. Michigan's guidance is specific: an employer may confirm that leave was used for a covered reason but cannot require you to name the condition. Employers also cannot confirm details of your specific CuroNote note without your permission; a physician's license status, by contrast, is public information anyone can check.
