Washington sick-leave & employer-note context

Washington's statewide paid-sick-leave law, enacted by voters through Initiative 1433, has required nearly all employers to provide paid sick leave since 2018. Employees accrue at least one hour of paid sick leave for every 40 hours worked, with unused balances carrying over up to a yearly cap. The law limits verification: an employer can generally require it, which can include a note, only for paid-sick-leave absences exceeding three consecutive days the employee was scheduled to work, only under a written policy, and without creating an unreasonable burden on the employee. Seattle and Tacoma also have their own paid-sick-leave ordinances that operate alongside the state law.

Washington’s paid sick leave law and its three-day verification rule

Washington’s paid sick leave law, created when voters approved Initiative 1433 in 2016, has required nearly all employers, regardless of size, to provide paid sick leave since January 1, 2018. Employees earn at least one hour of paid sick leave for every 40 hours worked, and unused balances of up to 40 hours generally carry over to the next year.

The law also limits when an employer can ask for proof. An employer may require verification, which can include a doctor’s note, only for paid-sick-leave absences exceeding three consecutive days the employee was scheduled to work, and only under a written policy that doesn’t create an unreasonable burden or expense for the employee. Seattle and Tacoma each layer their own paid-sick-leave ordinance on top of the state law, and where local rules are more generous, employees get the better protection.

Verifying a physician’s Washington license

The Washington State Department of Health maintains a free Provider Credential Search covering physicians and other licensed health professionals. Anyone can search by name or credential number to confirm a physician’s Washington license is active and review any public disciplinary action taken since 1998. That lookup checks the doctor’s credentials. It’s a different question from whether you choose to share your own note, or its details, with your employer, which is your decision to make.

Before CuroNote launches in Washington
